Expert Witness Testimony
Price Postel and Parma (PPP) retained Barry as an expert witness on land use planning matters in an eminent domain lawsuit that proceeded to trial. PPP represented the Park District, which was assembling land to create a new regional park along the North Richmond shoreline. Barry’s work included detailed analysis of land use, environmental, and planning issues associated with the acquisition of the 238-acre Breuner Marsh, as well as evaluation of the feasibility of alternative land uses given the site’s proximity to sea level. The property owner contended that the site’s value was significantly higher and that it was suitable for residential development.
In addition to preparing written analyses, Barry was deposed and later testified before a jury at trial. The Park District prevailed, and the property is now preserved as Dotson Family Marsh, part of Point Pinole Regional Park.
